These Terms of Service (“Terms”) govern your use of our platform (the “Platform”), including any hosted storefront (each a “Store”), related design/print assets, and setup services.



By accessing or using the Platform or any Store, you agree to these Terms. If you do not agree, do not use the Platform or Stores.



1. Roles



We / Platform: Provide hosting, setup tooling, and related services that enable Stores.



Store Operators: Independent sellers who create and operate Stores on the Platform.



Customers / Buyers: People who browse or purchase from Stores.



Store Operators are responsible for their own Store content, product descriptions, pricing (where applicable), customer service for their orders, and compliance with law.



2. Eligibility



You must be legally able to enter a binding contract in your jurisdiction. If you use the Platform on behalf of a business, you represent that you have authority to bind that business.



3. Store Setup Packages



We may offer paid setup packages (for example, packages based on a number of products/items). Setup fees may include design work, print files, and hosted storefront services as described at checkout or in the order confirmation.



• Setup fees are generally non-refundable once work has begun or digital assets/services have been delivered, except where required by law.

• Package details, item limits, and pricing may change; the terms shown at purchase control for that order.

• You must provide accurate information (including PayPal email, Store name, contact email, and branding assets).



4. Accounts and Store Operator Responsibilities



If you set up or operate a Store, you agree to:

• Provide accurate, current information

• Keep login and payment details secure

• Use only content (logos, images, names, designs) that you have rights to use

• Not upload unlawful, infringing, deceptive, or harmful content

• Comply with payment-provider rules (including PayPal) and tax/consumer laws that apply to your sales

• Handle customer communications and fulfillment obligations for your Store’s orders, unless we expressly agree otherwise in writing



We may suspend or remove a Store for violation of these Terms, suspected fraud, legal risk, or non-payment.



5. Purchases from Stores



When you buy from a Store:

• Your purchase is generally a transaction between you and the Store Operator, facilitated through the Platform and/or payment providers.

• Product availability, shipping times, and fulfillment details are provided by or on behalf of the Store Operator.

• Payment processing is handled by third parties (such as PayPal). Their terms also apply.



If there is a problem with an order, contact the Store’s listed contact email first. We may help facilitate communication but are not the seller of record unless we expressly say so for a specific product.



6. Pricing, Taxes, and Fees



Prices, shipping charges, and taxes (if any) are shown at checkout where applicable. You are responsible for any taxes associated with your purchases or Store sales, except where a payment provider or we are legally required to collect them.



7. Intellectual Property



• The Platform, software, branding, and our original materials are owned by us or our licensors.

• Store Operators retain ownership of their uploaded branding and content, and grant us a worldwide, non-exclusive license to host, display, reproduce, and process that content as needed to operate the Store and Platform.

• Design files and print-ready assets created as part of a paid setup package are licensed to the Store Operator for use in connection with their Store and related production, unless otherwise agreed in writing. Redistribution, resale, or claiming sole authorship of Platform templates/systems may be restricted.

• You may not copy, scrape, reverse engineer, or misuse the Platform except as allowed by law.



8. Acceptable Use



You may not:

• Use the Platform for illegal activity

• Infringe intellectual property, privacy, or publicity rights

• Upload malware or attempt unauthorized access

• Interfere with Platform security or operations

• Misrepresent affiliation with us or other Stores

• Use the Platform to sell prohibited or highly regulated goods without authorization



9. Third-Party Services



The Platform may integrate with third-party services (payments, hosting, analytics, print/fulfillment). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party outages or policy changes beyond our reasonable control.



10. Disclaimers



THE PLATFORM AND STORES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.



We do not guarantee uninterrupted service, error-free operation, or that any Store will achieve any particular sales results.



11. Limitation of Liability



TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES.



OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR SETUP/PLATFORM SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.



Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent allowed.



12. Indemnification



You agree to defend and indemnify us against claims, damages, and expenses (including reasonable attorneys’ fees) arising from: your misuse of the Platform; your Store content or products; your violation of these Terms or law; or infringement claims related to content you provide.



13. Termination



You may stop using the Platform at any time. We may suspend or terminate access to the Platform or any Store if you breach these Terms, create risk, or fail to pay required fees. Provisions that should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.



14. Changes to the Terms



We may update these Terms. The “Last updated” date will change when we do. Continued use after changes means you accept the updated Terms. If a material change requires notice under law, we will provide notice as required.



15. Governing Law



These Terms are governed by applicable law in the jurisdiction where the Platform operator is established, without regard to conflict-of-law rules, except where prohibited by consumer-protection law.
